The tax man cometh: How will church institutions pay for health reform?

WASHINGTON (CNS) -- As the head of a small evangelical college serving 2,400 undergraduates and 600 graduate students, the Rev. Philip Graham Ryken has no quarrel with contraception on religious grounds but doesn't want any part of a health insurance plan that offers certain drugs that can cause abortions.

So the president of Wheaton College in Illinois has vowed to resist requirements under the new health care law to provide all contraceptives approved by the Food and Drug Administration -- including two that can prevent implantation of a fertilized egg -- free of charge to its employees.

If the school is unable to offer health coverage which complies with its moral and religious beliefs, that position could put him in line for taxes and penalties totaling $1.4 million a year for faculty and staff alone, Rev. Ryken said at a recent teleconference announcing a lawsuit against the contraceptive mandate.

"This is a time to be cutting costs, not adding costs to university budgets," he said.

Beginning Jan. 1, 2014, employers with 50 or more full-time employees that do not offer health insurance will be subject to a fine of $2,000 per employee, excluding the first 30 employees, if any employee receives a premium tax credit.

Those tax credits will be available to individuals and families with income between 133 percent and 400 percent of the federal poverty level. In 2012, the federal poverty level was $11,170 for an individual and $23,050 for a family of four, meaning that tax credits could go to families of four with income as high as $92,200.

With more than 107,000 faculty and staff members at more than 200 U.S. Catholic colleges and universities, the total potential tax liability in Catholic higher education could be staggering if they feel compelled to drop their insurance. Add to that the nation's 629 Catholic hospitals employing more than 640,000 people, and the 381,000 people who work in 3,300 local Catholic Charities offices around the country, and the costs could swamp an already financially beleaguered U.S. Catholic Church.

But the penalty on employers is far from the only tax contained in the Patient Protection and Affordable Care Act. The best known is the individual mandate, affirmed by the U.S. Supreme Court as a tax, which could cost those without health insurance up to $295 or 2.5 percent of taxable income, whichever is greater, by 2016.

Taxes related to the individual mandate -- assessed by the Internal Revenue Service -- begin at $95 per person or 1 percent of taxable income in 2014 and go up from there. Those without coverage for less than three months, American Indians, prisoners, undocumented immigrants, those who have religious objections to obtaining health insurance and those whose incomes are below the tax filing threshold will be exempt.

One of the first taxes to take effect after the March 2010 passage of the Affordable Care Act was a 10 percent tax on indoor tanning services, imposed since July 1, 2010.

Among the others:

-- An increase in Medicare payroll taxes from 1.45 percent to 2.35 percent on earnings over $200,000 for individuals and $250,000 for married couples filing jointly, effective Jan. 1, 2013.

-- An excise tax of 40 percent to be imposed on so-called "Cadillac coverage" health insurance plans valued at $10,200 for individual coverage and $27,500 for family policies, beginning Jan. 1, 2013. The tax will apply only to amounts above the thresholds and will be levied on insurers and self-insured employers, not directly on employees.

-- Annual fees of up to $4.1 billion (in 2018) on the pharmaceutical manufacturing sector. The fee for 2012-13 was $2.8 billion.

-- Annual fees of up to $14.3 billion (in 2018) on the health insurance sector. The first fee, of $8 billion, is to be imposed in 2014.

Those who itemize deductions on their tax returns will see the threshold for medical deductions rise from 7.5 percent of adjusted gross income to 10 percent beginning in 2013, except for people 65 and over. Contributions to flexible spending accounts for medical expenses will be capped at $2,500 a year in 2013, with any later increases pegged to the cost of living.

Other taxes and penalties are likely to arise as various federal agencies issue their final regulations related to the health care law.

Jonathan H. Adler of Case Western Reserve University School of Law in Cleveland and Michael F. Cannon of the Cato Institute contend that the IRS has erred in ruling that those who live in states that decline to establish state insurance exchanges can get the same tax credits and subsidies as the participants in state-run exchanges.

Although the health reform law calls for the establishment of a federal insurance exchange for those not covered by a state exchange, it does not allow for the extension of tax credits, Adler and Cannon said in an article to be published in an upcoming issue of Health Matrix, a journal that focusing on the intersection of law, ethics, medicine and policy.

"The text, structure and history of the (Affordable Care) Act show that tax credits and subsidies are not available in federally run exchanges," they say. "The IRS rule is contrary to congressional intent and cannot be justified on other legal grounds."

And because the tax credits can trigger fines on employers who do not provide health insurance, they added, the IRS rule is likely to end up in court -- joining some two dozen other lawsuits challenging aspects of the health reform law.

Syrian regime claims gains in Aleppo, rebels deny

BEIRUT (AP) ? Syrian government forces mounted new ground attacks against rebel-controlled neighborhoods in Syria's commercial hub of Aleppo, the state media said Monday, but failed to dislodge the opposition from their strongholds, according to activists.

The Syrian army has massed its forces around Aleppo, where rebels hold several neighborhoods after a 10-day offensive, and has been pounding it with tanks and helicopter gunships. There have also been periodic incursions of government tanks but the rebels have held on to their gains.

This use of heavy weapons, particularly helicopters, is just another nail in President Bashar Assad's coffin, U.S. Defense Secretary Leon Panetta said late Sunday during a stopover in Tunisia as he kicked off a Mideast tour expected to focus heavily on the unfolding crisis in Syria.

Already an estimated 200,000 civilians ? almost 10 percent of the population ? have fled the fighting in Aleppo, according to the U.N. official for humanitarian affairs, Valerie Amos, citing the International Committee of the Red Cross and the Syrian Red Crescent. Aleppo is Syria's largest city with around 3 million inhabitants.

Syrian state media reported late Sunday that the army had "purged" Aleppo's southwestern neighborhood of Salaheddine and inflicted "great losses" upon the rebels in one of the first districts they took control of in their bid to seize the city.

There was also a successful operation in Sukhour neighborhood, in the northeast of the city and another rebel stronghold, the state media said.

Activists, however, disputed these claims and just described another day of fierce shelling of certain areas, backed up by the occasional foray on the ground.

"They have tanks in nearby Hamdaniya and there is fighting, and there have been random bombardments of Salaheddine," said Mohammed Saeed, who is based in the embattled city.

While giving no indication that the Obama administration is contemplating military intervention, Panetta said it is increasingly clear that the Syrian crisis is deepening and that Assad is hastening his own demise.

"If they continue this kind of tragic attack on their own people ... I think it ultimately will be a nail in Assad's coffin," Panetta told reporters traveling with him from Washington. "His regime is coming to an end."

Assad's regime has been plagued by a string of defections, including three high ranking diplomats and several military commanders. On Monday, a Turkish official announced that a Syrian brigadier general who was deputy chief of police in Syria's Latakia region, had defected.

The general was among a group of 12 Syrian officers who crossed into Turkey late Sunday, the official said, speaking on condition of anonymity because of Turkish government rules. His defection raises the number of generals to have left for Turkey since the start of the 17-month-old uprising to 28.

But Syria's army remains mostly intact and still vastly outguns the rag-tag rebel army, which is armed for the most part with assault rifles, machine guns and doesn't have the heavy weapons necessary to effectively oppose tanks and helicopter gunships.

The government boosted its forces outside Aleppo and began an assault over the weekend to retake the commercial hub, bombarding rebel neighborhoods and leaving streets littered with rubble and empty apartment blocks with gaping smashed windows, according to videos of the city posted online in recent days.

Fleeing residents described to The Associated Press incessant shelling, shortages of food and gasoline and soaring black market prices for everyday staples.

"I am extremely concerned by the impact of shelling and use of tanks and other heavy weapons on people in Aleppo," Amos said in a statement from New York late Sunday. "Many people have sought temporary shelter in schools and other public buildings in safer areas. They urgently need food, mattresses and blankets, hygiene supplies and drinking water."

She added that while the fighting made getting to the needy very difficult, the U.N. agencies and the Red Crescent were continuing their efforts to deliver food, blankets and hygiene kits.

WASHINGTON (CBSDC) ??Male U.S. veterans are twice as likely to identify themselves as female compared to male civilians, according to a new study from a leading researcher in transsexuals in the military.

Nearly 24 years after research indicated that male-to-female transsexuals enlist in the military as a way to exhibit more masculinity, new data on the subject suggests that men who serve in the military are much more likely to identify as transgender than men who do not serve in the military. Following up on his 1988 paper, ?Transsexuals in the Military: Flight into Hypermasculinity,? psychologist George Brown has compiled research of more than 5 million service members that he says cements his earlier research. Brown?s 1988 paper relied on interviews from 11 male service members who identified themselves as female.

?I have data from a study I did in VA that demonstrates a prevalence double that in the nonmilitary population,? Brown told Courthouse News. ?It is unpublished data, pending presentation in San Francisco in the fall. It totally supports my 1988 work. The denominator in the study is over 5 million veterans. So, I am now confident that my early theory was correct.?

Brown, a veteran of the U.S. Air Force and a former member of the Department of Veterans Affairs, could not go into further detail about his findings as the study has yet to be published, citing confidentiality matters.

The study comes four years after the American Psychological Association?s Task Force on Gender Identity and Gender Variance concluded in 2008 that one in almost 12,000 male-to-female transsexuals had gone through some form of gender identity disorder, according to Courthouse News. Regulations from the Department of Defense hold firm to the stance that people who identify themselves as transgender are not allowed to serve in the military.

Others, such as Aaron Belkin, director of UCLA?s Palm Center, an institute for studying the military?s sexual minorities, believe that Brown?s research, which includes the idea that transgender service members volunteer for the more dangerous missions, is ?path-breaking.?

?Warrior identity and military masculinity are so revered in this society that people will do whatever it takes, including dying, for people to prove that they are ?real men,?? Belkin told Courthouse News. ?The fact that many [male-to-female] transgender individuals join the military to prove that they are ?real men? is a sad testament to the culture?s idealization of warrior masculinity.?

Brown?s research is the latest in the ongoing discussion of whether male-to-female transsexuals have a role in the military. The defense team for Bradley Manning, the alleged source behind the enormous intelligence leak that led to WikiLeaks, has pleaded in the past that Manning?s mental health was significantly affected by military standards against transgender troops.

Brown has not indicated when or where the study would be published.

Writing, speaking, and thinking in other languages and voices

It began last summer after a week of stress and lack of sleep, I was awake a total of 48 hours. Lost in a thought of fasting for spiritual enlightenment, it began. My body would not do what I wanted it do, I was speaking in different languages, and in different voices. Many of the "scenes" that I was "acting" out were of people dying, a young man, an elderly woman, a tortured man, etc. etc. I knew the type of person and how they were dying. After that I began to write in a form that has been classified as nothing, as an Asian form of writing, and ancient form, or just plan scribbles. From that night on things have been occurring, more writings, more speaking, and more death. Then influence came and symptoms of depression and anxiety were very prominent. I could not concentrate. I was never happy. I cried often. I became a different person, doing things that I would never do. This included drinking too much, lying, cheating, having cruel thoughts, having a total disregard for anything or anyone I loved. I cared for nothing and I was nothing. I hated my job, I hated being home, and I hated repeating the same cycle over and over. I lost myself and I felt like something was influencing me. All this faded for a little while but, I'm feeling it again, and the writing is there sometimes. The speaking of languages occurs. I have hated my job since day one and still do, but I bare with it. Every time I make the decision to apply and find a new one something stops me. Every time I feel things are going good, something chaotic happens like a fight, major money issues, a car accident, being sick, someone dying, etc. I get extremely restless or anxious on very bad days and can't sit still or relax. Sleeping has been a problem since this started. From extreme insomnia to losing 2-3 hours of sleep a night from either not being able to go to sleep to me waking up early. Nothing feels right during the bad days, and like I said before; when things do feel right complete chaos happens...

Anybody else have something like this going on?
I would really like to talk with someone who has ever been through, or know someone who has been through something similar.

A tornado warning has been called off for Dryden ? Vermilion Bay early Sunday evening, but a new warning has been issued for Seine River Village ? Mine Centre.

Environment Canada issued a tornado warning for Seine River Village ? Mine Centre just before 6 p.m. ET, warning people in the area to ?be on the lookout for adverse weather conditions and take necessary safety precautions.?

(AP) ? Facebook's stock hit a new low Friday after it reported lukewarm second-quarter results and didn't give an outlook for the coming months.

The stock fell $2.88, or nearly 11 percent, to $23.97 in afternoon trading Friday, after earlier trading as low as $22.28.

Facebook Inc.'s initial public offering of stock priced at $38, and its low had been $25.52, hit on June 6. The stock is now about 37 percent below its IPO price.

Facebook issued its first financial report as a public company after the market closed Thursday. The company reported slightly stronger-than-expected revenue and a gain in user numbers, but investors weren't impressed.

Although revenue grew 32 percent in the second quarter, growth has slowed from earlier this year and from previous years. That's a concern for a newly public company. Investors are willing to value new companies highly, even if they are not making a profit, because they expect booming revenue.

Baird's Colin Sebastian also pointed out that the company is spending more on technology and hiring, driving up expenses.

But he's not overly concerned. He backed his "Outperform" rating for Facebook, saying advertising revenue was better than expected and the company is improving its ability to make money from users who access Facebook from apps on their phones and tablet computers.

Other analysts remained positive, too. Of 27 analysts available from FactSet, 15 have "Buy" ratings or equivalent, while just three are a "Sell." Analysts tend to have longer-term views of stocks than many day-to-day investors.

Mobile and users in developing countries are driving growth in active monthly users, Sebastian said. Facebook had 955 million active monthly users as of June 30, up 29 percent from a year ago.

"We don't view these results as dramatically good or bad," said Citi analyst Mark Mahaney. "Key questions remain: the future of Facebook mobile monetization and the future of Facebook user engagement."

Analysts also cautioned that the stock could be volatile because Facebook didn't offer investors and financial analysts its outlook for the rest of the year.

Overall the company reported a loss of $157 million, or 8 cents per share, in the April-June period, mainly because of compensation expenses it incurred when it paid $1.3 billion in restricted stock and related taxes for employees as part of the IPO. The loss compared with earnings of $240 million, or 11 cents per share, in the second quarter a year ago.

The company's adjusted earnings of $295 million, or 12 cents per share, matched Wall Street's expectations.

Facebook's revenue of $1.18 billion was slightly higher than the $1.16 billion expected by analysts surveyed by FactSet.

The results came two months after Facebook's stock flopped on its first trading day, on May 18. The day began with glitches with the Nasdaq Stock Market that delayed trading by half an hour. It didn't get much better from there. Despite months of hoopla that had investors thinking it would soar, the stock closed just 23 cents above its $38 IPO price. It has not reached that level since.

Investors were holding out hope that Facebook would far exceed expectations ? even though the company effectively warned investors before its IPO that Wall Street's expectations were too high. In a filing issued a week before its IPO, for instance, Facebook said its mobile users are growing at a faster pace than the number of ads on its mobile platform.

Analysts took that as a sign that their estimates were out of whack and many of them reduced their estimates for Facebook's projected revenue and earnings.

Even though the number of people who use mobile devices and tablet computers to access Facebook had been growing fast, Facebook didn't start showing ads on its mobile app until this spring. Facebook had 543 million active monthly mobile users at the end of the quarter, a 67 percent increase from a year earlier.

In a conference call with analysts Thursday, CEO Mark Zuckerberg said Facebook's mobile users are more active than those who use the personal computer version.

"On average mobile users are around 20 percent more likely to use Facebook on any given day," he said. "So mobile not only gives us the potential to connect more people with our services and also gives us the ability to provide more value and more deeply engaging experience."

Facebook said its revenue from advertising totaled $992 million, a 28 percent increase from the same quarter last year. That number accounted for 84 percent of total revenue. The company did not say what portion was from mobile advertising. The rest came from payments and other fees, money Facebook makes from Zynga games and other apps.

(AP) ? As tea party superstars smelling an upset close ranks around conservative insurgent candidate Ted Cruz, traditional Republican favorite David Dewhurst is leaning on his party's old guard.

The Texas lieutenant governor is hoping to regain the air of inevitability that once made him look like a slam-dunk in the race for U.S. Senate.

Dewhurst racked up another key endorsement on Thursday, appearing at a running-shoe shop in Austin with Texas Comptroller Susan Combs, who said the state has $6.1 billion saved in its rainy day fund because Dewhurst kept state lawmakers from raiding it.

"David Dewhurst, in the Senate, held the line in keeping that money set aside for the future," Combs said.

Cruz and Dewhurst square off Tuesday in a runoff election, with the winner considered the overwhelming favorite to prevail in November's general election.

Dewhurst has overseen the state Senate since 2003 from the powerful lieutenant governor's post. He has been endorsed by Gov. Rick Perry and most of the Texas GOP establishment in the race for the Republican nomination to replace retiring U.S. Sen. Kay Bailey Hutchison.

He beat Cruz by 10 percentage points in the May 29 state primary but fell short of an outright majority in a field featuring nine Republican senate hopefuls.

Combs' nod came as state Sen. Dan Patrick, a Houston Republican, also endorsed Dewhurst. Patrick is a tea party favorite himself and has clashed frequently with the lieutenant governor, but he also got into a high-profile yelling match with Cruz during a recent radio interview. The race has become one of the nation's most-watched ? seen as a test of the tea party's grassroots prowess against mainstream Republicans in Texas who don't lose many elections: a Democrat has not won statewide office here since 1994.

But this time the challenge is coming from the far-right, and coming hard. Cruz was in Dallas on Thursday for a major tea party rally featuring U.S. Sens. Rand Paul of Kentucky and Mike Lee of Utah, as well as radio host Glenn Beck and former U.S. Rep. from Texas, Dick Armey ? chairman of the grassroots group FreedomWorks.

Meanwhile, the Tea Party Express parked a bus doubling as a "mobile phone bank" in the Dallas suburb of Irving to get out the vote for Cruz.

Another major Cruz bash Friday in Houston was expected to feature former Alaska Gov. Sarah Palin. She had previously recorded a phone message to voters for Cruz but had not traveled to Texas on his behalf.

Cruz, the former state solicitor general, strikes a fiery, populist tone. The tea party also has targeted Dewhurst because, while he has overseen some of the most conservative legislatures in Texas history, he has also occasionally compromised with Democrats to approve key legislation.

Dewhurst also has a halting, at times uneasy speaking style. But he says he never reached out to national tea party leaders because he's been too focused on Texas issues.

"I'm comfortable that there are more Dewhurst voters in Texas than Cruz voters," Dewhurst said Thursday. "The challenge to both of us is turnout."

A court battle over redistricting maps pushed the Texas primary from Super Tuesday to May 29, which means the runoff is coming when many Texans may be on vacation. About 1.4 million people voted in the primary, but fewer than 1 million are likely to return for a second round of balloting.

Cruz has gotten millions of dollars from national conservative groups, including the Washington-based Club for Growth. Dewhurst, who has a personal fortune topping $200 million as the owner of an energy business, has lent his campaign more than $10 million. Both sides have flooded the airwaves statewide, with Dewhurst attacking Cruz as beholden to his out-of-state benefactors and Cruz branding the lieutenant governor as a two-faced moderate.

Cruz has vowed to win the runoff, saying his supporters are motivated enough to turn out no matter what.

"We're seeing very strong enthusiasm among our base. Not only voters, but volunteers who are block-walking, phone-banking and pouring their blood, sweat and tears into this campaign," said James Bernsen, a spokesman for the Cruz campaign.

Dewhurst is countering by campaigning with Perry the day before the election, visiting a San Antonio veterans center before heading to a joint fundraiser in Dallas.

But the lieutenant governor is also quietly mobilizing his own supporters. He's using networks of volunteers organized by groups across the state that have endorsed him, including the Texas Association of Business and the Texas Farm Bureau, which is especially strong in rural areas ? where Dewhurst largely beat Cruz handily during the primary.

Also Monday, Dewhurst will make his first visit to his campaign's major phone-banking operation in Dallas to fire-up his hardcore supporters. Perry will also be there as will the Republican third- and fourth-place finishers in the primary, former Dallas Mayor Tom Leppert and ex-NFL running back and ESPN commentator Craig James ? both of whom have since endorsed the lieutenant governor.

"They're not just endorsing us and 'see you later,'" said Dewhurst spokesman Matt Hirsch. "They're out there campaigning for us."

New drug could help maintain long-term weight loss

ScienceDaily (July 26, 2012) ? A new drug could aid in losing weight and keeping it off. The drug, described in the journal Cell Metabolism on July 26, increases sensitivity to the hormone leptin, a natural appetite suppressant found in the body. Although so far the new drug has only been tested on mice, the findings have implications for the development of new treatments for obesity in humans.

"By sensitizing the body to naturally occurring leptin, the new drug could not only promote weight loss, but also help maintain it," says senior study author George Kunos of the National Institute on Alcohol Abuse and Alcoholism. "This finding bodes well for the development of a new class of compounds for the treatment of obesity and its metabolic consequences."

Although leptin is an appetite suppressant, leptin supplements alone have not been effective at reducing body weight in humans. It's thought that this is because of desensitization to the hormone; leptin is still there, but our bodies can no longer respond to it. While it is not entirely clear how this desensitization occurs, cannabinoid receptors, which mediate the feelings of hunger produced by marijuana and naturally occurring cannabinoids in the body, are thought to be involved. So blocking these receptors, rather than providing excess leptin, could be more effective at long-term weight loss. Knowing that marijuana use causes the munchies, scientists had developed anti-obesity drugs that target cannabinoid receptor type 1 (CB1R). One CB1R-binding drug called rimonabant was sold in Europe beginning in 2006, but it was taken off the market a few years later due to serious psychiatric side effects, including anxiety, depression and thoughts of suicide.

To minimize these side effects, Kunos and his team previously developed a CB1R-targeting drug that did not enter the brain as easily as rimonabant. However, the drug was not as effective at reducing weight and improving metabolic health, possibly because of its specific mode of action. In the new study, Kunos tested a new compound, JD5037, that targets CB1R without penetrating the brain. JD5037suppressed the appetite of obese mice, caused weight loss, and even improved metabolic health, in part by resensitizing mice to the appetite-suppressing hormone leptin. Importantly, the mice did not show signs of anxiety or other behavioral side effects.

"Obesity is a growing public health problem, and there is a strong need for new types of medications to treat obesity and its serous metabolic complications, including diabetes and fatty liver disease," says Kunos.

One must be careful to leave very hot towel, especially when used on sensitive skin of young children. This treatment for the flu usually lasts only while applying the compresses.
